This article fails to address the reason why the city has so many hot dog and halal food vendors who sell the same, exact, crappy hot dogs and Snapple on every street corner. The reason is The Department of Health requires that every food vendor present a notarized letter from a “Certified Food Commissary” stating that the cart is stored, cleaned and stocked with food there. This is a requirement in order to be licensed and it is a government sponsored racket. The certified commissaries have no incentive to provide new, interesting, healthy or market-driven food items because it is a closed system with a limited number of players. Vendors must pay hundreds of dollars for the commissary letter in order to be licensed and the system benefits no one other than the owners of the commissaries. Most likely, the “gentrified” vendors who are selling more gourmet items like cupcakes or even espresso have to break the law by purchasing their food from a specialty provider. These vendors, who are simply responding to a market need in a city of foodies, become subject to abuse by the “traditional” vendors because they don’t want to play the game. The folks at the Dept of Health and the Dept of Consumer Affairs are doing nothing to address this issue while the pockets of a handful of commissary owners are being lined.
